For the past 18 years, Michael Page has represented a wide range of clients in cutting edge litigation in all manner of intellectual property disputes, ranging from the United States Supreme Court, the Federal Circuit, and the Second and Ninth Circuits, to district courts around the country. He was lead counsel for Grokster in copyright litigation against all of the major motion picture studios and record companies at the district court, the Ninth Circuit, and the Supreme Court, for which he received the 2005 CLAY Award (California Lawyer Attorney of the Year). Michael was lead trial counsel in the Geico v. Google trademark case in the Eastern District of Virginia, where he obtained a JMOL verdict in Google's favor in trademark litigation challenging the legality of Google's AdWords program. Michael has successfully defended Google's trademark policies in several other cases, including American Blind v. Google (N.D. Cal.). In patent litigation, Michael was plaintiff's lead counsel in InterTrust v. Microsoft (N.D. Cal.), which resulted in a $470 Million settlement and license of digital rights management patents.
Michael has also represented clients such as Hummer Winblad Venture Partners in the Napster litigation, 321 Studios in litigation against the major motion picture studios, Cadence Design Systems in trade secret litigation against Avant! Corporation, eBay in DMCA and Copyright litigation, Google in multiple trademark and cybersquatting cases, and Linden Labs in copyright and trademark class action litigation. Other significant intellectual property clients have included America Online; Nintendo; Electronic Arts; Sega; Nullsoft; Palm Computing; 3Com; Harris Corporation; Heartport; Quark; E-Loan; and Tegal.
Michael has published several articles on copyright law, and is a frequent speaker on issues of cyberlaw and copyright. He is a member of the San Francisco Bay Area Intellectual Property Inns of Court, which has been closely involved in drafting and commenting on the Northern District's Model Patent Jury Instructions and Patent Local Rules. He has been an attendee and panelist at the Northern District Judicial Conference, and has been recognized by Chambers & Partners as a leading practitioner in Intellectual Property.
The law is not Michael's first career. Prior to attending law school, Michael spent thirteen years on the road as tour manager, production manager, or sound engineer for various international artists such as Daryl Hall & John Oates, Neil Young, The Cars, Herbie Hancock, Robert Palmer, Wayne Shorter, and many others who have long since rightfully faded from our collective memories. After meeting and marrying the opening act's tour manager (and now wife of 25 years), Michael left the road and "dropped in" to Boalt Hall, where he was managing editor of the California Law Review and was awarded the Order of the Coif. Mr. Page clerked for the Honorable Samuel Conti of the Northern District of California. Before joining Durie Tangri, Michael was an associate at Howard Rice until 1995, when he joined Keker & Van Nest, where he was a partner until 2008. Michael's obsessions include cycling, watching his three teenage sons play lacrosse and soccer, and listening to all manner of music, primarily Bruce Springsteen, Miles Davis, and Little Feat.
